What Is UIDDA Domestication
Before the Uniform Interstate Depositions and Discovery Act, obtaining discovery from a witness or business located in another state meant filing a separate legal action often called a “miscellaneous proceeding” in that state’s court, usually with the help of local counsel. It was slow, expensive, and added weeks to a case timeline. UIDDA changed that. Adopted by nearly every state, it allows a subpoena issued by the court where a case is pending (the “originating” court) to be submitted directly to the clerk of court in the state where the witness or records are located (the “receiving” court). The receiving court’s clerk then issues a new, locally valid subpoena no judge, hearing, or separate lawsuit required. That subpoena is served under the receiving state’s rules and is fully enforceable there.
